Standard Terms and Conditions for photography assignments.

By using the photographic services of Shaun Gibbs you hereby agree to comply with all the terms and conditions a set out on this page.

Copyright
The copyright in the images photographed by Shaun Gibbs is owned by and retained by Shaun Gibbs. These images may not be on-sold, leased, or given to 3rd party commercial entities without written permission from Shaun Gibbs.

Licence
Upon full settlement of our invoice the client is granted a licence which entitles the client (or their appointed agent) to use the photographs for the purpose for which they were originally commissioned, without any further royalties, e.g. marketing of a property for sale. The Licence cannot be transferred without  permission in writing from Shaun Gibbs. The licence is automatically revoked if the client is placed into receivership or liquidation. 

Promotional Use
Shaun Gibbs retains the right to use images for the purpose of self promotion, e.g. advertising on my website portfolio.

Client's materials
The Client accepts full responsibility for any materials that they supply for use in the images and that the materials are adequately insured against loss, damage or liability.

Travel
Agree to pay the additional rate over and above the first free hour as stated on the Pricing page.

Payment
Full payment by the client will be required before photos are released. Payment terms can be negotiated 

Indemnity
Shaun Gibbs shall not be liable for any legal action, claim or damages resulting from or arising out of the publication of the images or other use by the client. The client shall indemnify Shaun Gibbs against any claims and/or damages as a result of the client’s use of the images.

Client Approval
If the client is not present or represented by an agent during the photography shoot then interpretation of the assignment by Shaun Gibbs will be accepted.

Client Confidentiality 
Shaun Gibbs treats and respects any information the client provides provide as strictly confidential and will not be sold or traded to a thrid party. 

Variation
These terms shall not be varied except by agreement in writing both the client and Shaun Gibbs..
